Scott is listed on the Alabama Center for Dispute Resolution Roster for mediation, arbitration, and private judging as well as the Alabama Appellate Mediator Roster. He has completed the 40-hour Domestic Relations Mediation Training and 12-hour Domestic Violence Mediation Training.

 

Scott is an instructor for the Alabama Mediation Training 40-hour course that is approved by the Alabama Dispute Resolution Center as providing the educational component for roster membership on both the civil and domestic relations rosters and which also provides 40 hours of CLE credit for Alabama attorneys, including two hours of Ethics. Private Judging

Attorney Scott Donaldson’s experience as a circuit judge qualifies him to serve as a private judge under Alabama law.

 

Private judging provides disputing parties with basically all of the same rights and opportunities of a standard filed case but with greater flexibility. 

Alabama Code sections 12-11A-1 et seq. set forth the requirements and procedures for a case to be decided by a private judge in Alabama.

A private judge must have, among other qualifications, served as a judge for at least six consecutive years. A private judge may be used, under the statutory procedures, in cases over which the court in which the former judge served would have had subject matter and monetary jurisdiction.

 

The case will be tried non-jury and will be recorded with the clerk’s office and treated as any other active case but can be heard at any time and at any place in Alabama. Appeals can be taken from rulings of private judges just as if the case were heard by a sitting judge. The private judge is compensated by the parties.
